You are hereby notified that the City Council will meet in the Training Room of City Hall located at 600 DeMers Ave on Wednesday, July 5th at 5:00pm or as soon as possible thereafter, to consider adopting a moratorium of the City Code, prohibiting the sale, testing, manufacturing, cultivating, growing, transporting, delivery, and distribution of cannabis products in the city of East Grand Forks.
A brief summary follows:
The 2023 Legislature intends to expand both the legalization of types of THC and cannabis products and also the types of THC and cannabis businesses permitted. The House passed HF100, and the Senate passed a similar companion bill, SF73 the Governor has s sign the resulting bill which takes effect July 1, 2023. This final bill established a regulatory framework for adult-use cannabis.
The state licensing agency may become effective July 1, 2023, and it may establish a model ordinance for cities, which the City of East Grand Forks would benefit from reviewing and analyzing before making any decisions related to cannabis businesses and products in the City.
The final bill specifies what distance restrictions cities can put in place under their zoning power. The city would benefit from having time to study and analyze acceptable time, place and manner restrictions that would be feasible for the City of East Grand Forks.
The City is authorized to enact by ordinance a moratorium to regulate, restrict or prohibit land uses within its jurisdiction to protect the public health, safety, and welfare to allow it to undertake a study to determine whether to adopt any regulations or restrictions. The City shall have authority to adopt an interim ordinance to prohibit a cannabis business from opening until January 1, 2025.
At this meeting, the City Council will decide if it will enact a moratorium and request a study.
